A Conversation with Cynthia Giles on Next Generation Compliance: Environmental Regulation for the Modern Era

Cynthia Giles’ book, Next Generation Compliance: Environmental Regulation for the Modern Era, is an in-depth exploration of how to achieve environmental results through better design of environmental rules so that those rules can be more easily enforced. Ms. Giles is one of the most experienced environmental enforcement experts, having spent more than two decades working in the field at both the state and federal levels, including holding the top enforcement position at the U.S. Environmental Protection Agency during the Obama Administration, Assistant Administrator for the Office of Enforcement and Compliance Assurance. While in this position, she focused on methods for increasing the effectiveness of enforcement programs, including the use of electronic reporting, the role of advanced monitoring technology, and designing compliance into laws and regulations (an approach that became known as “Next Generation Compliance”).

As a result, Ms. Giles is in a unique position to understand what approaches to regulatory design result in effective implementation of environmental laws and regulations and what approaches to drafting statutes and regulations create barriers to assuring compliance.
